Lange tijd slaagde de Nederlandse wetgever er maar niet in om het ontslagrecht aan te passen. Nadat in 1996 de zoveelste poging daartoe was mislukt, ontwierp de Kring van Kantonrechters zelf de zgn. Kantonrechtersformule, die - inhoudelijk aanzienlijk gewijzigd - anno 2015 in de wet werd opgenomen als transitievergoeding en billijke vergoeding. Deze beschouwing uit 1997 is een kritische bespreking van de eerste Kantonrechtersformule uit 1997.
